CURB FERC regulations, which overreach and overregulate the  shorelines of its hydroelectric projects.

The Federal Energy Regulatory Commission (FERC) is trying to regulate far beyond the intended purposes of Bagnel Dam and Lake Ozark.  They want to regulate the Lake at a higher project boundary line that is originally in the deed for Bagnel Dam.  FERC will re-dedicate these lands to the Federal Govt.  Some Representatives want to “grandfather” in structures that are in question,  but in doing so we will be giving up our easement rights already mentioned in the original deed. 

The original deed already allowed many of these structures to be built.  If by “grandfathering” in these questionable structures we will in effect revoke our easement rights, along with any lake access we have now and the government will take control of the lake.  The original purpose of this lake was to create hydro electricity and a recreational lake.  It was never intended to be a corp of engineer project.

This FERC interference at the Lake will affect the property values as well, along with lake access problems on property we thought we owned and have been paying taxes on for many years.  Thousands of lots will be taken away from property owners.  We are asking you to go into the following web site and sign the petition to the White House, to stop FERC.  We need a minimum of 5000 votes.

Shoreline Management Plan

Dear Secretary Bose:

The purpose of this letter is to file comments regarding the Order Modifying and Approving Shoreline Management Plan issued by FERC to AmerenUE regarding Project 459.

While we agree that a comprehensive Shoreline Management Plan (SMP) should represent a balance between resource protection, enhancement and development, we believe that many of the revisions made to Ameren’s plan are excessive and do little to insure resource protection while creating a significant adverse effect on development to both business owners and lake residents.

Most significantly, the revisions clearly have the apparent intent and desired effect of removing what is referred to in the SMP as “non-conforming structures,” permitted or otherwise, from the Project Boundary. We do not believe that these more restrictive requirements are necessary, nor do they protect the lake’s resources.  Furthermore, we believe that Ameren should have the authority to authorize construction of structures on project lands, whose presence do not have a significant impact on specific project purposes. This authority should be allowed through the SMP and Ameren’s permitting process.  This would include, but not be limited to decks, gazebos, patios, and walkways along the shoreline and within the project boundary.
